TDC Livestock and Property (“TDC”, “we”, “us”, “our”) recognises the importance of protecting your privacy. This Privacy Disclosure Statement explains how we collect, hold, use and disclose personal information, and how you can access and correct your information or make a complaint.

 We aim to comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), which require organisations to manage personal information in an open and transparent way, including maintaining a clearly expressed and up-to-date privacy policy. 

 

1) What personal information we collect

 The kinds of personal information we may collect and hold include:

  • Identity and contact details: name, address, email, phone.
  • Property and transaction information: property interests, vendor/purchaser/lessor/lessee details, rural property and livestock transaction records, instructions and authorities, settlement details, insurance and compliance-related information (where relevant).
  • Financial and payment details: invoicing details, bank account details for payments/disbursements, and transaction records.
  • Verification information: identification details needed to verify identity and prevent fraud (e.g., licence details) where required or reasonable.
  • Communications and preferences: enquiry history, marketing preferences, feedback, complaints.
  • Website and device data (if applicable): IP address, device identifiers, log data, cookies/analytics data.

 We generally do not seek to collect sensitive information (such as health information). If we need to collect sensitive information, we will do so only where permitted by law and, where required, with your consent.

 2) How we collect and hold personal information

 How we collect: We collect personal information in a number of ways, including directly from you (in person, by phone, email, website forms, social media, or documents you provide) and, where relevant, from third parties such as:

  • other agents/agencies, vendors/purchasers/landlords/tenants,
  • referees (e.g., tenancy references),
  • service providers (e.g., IT, marketing, contractors),
  • public sources (e.g., title/property listings), and
  • government/industry bodies where relevant and lawful.

 How we hold: We hold information in electronic and/or hard copy form and take reasonable steps to protect it from misuse, interference, loss, and unauthorised access, modification or disclosure (e.g., access controls, secure systems, staff training and supplier management). APP 1 requires entities to implement practices, procedures and systems to support APP compliance. 

 3) Why we collect, use and disclose personal information

 We collect, hold, use and disclose personal information to:

  • provide livestock and property agency services (sales, leasing, property management, rural/livestock transactions),
  • respond to enquiries and communicate with you,
  • prepare and administer agreements, authorities, marketing materials and transaction documents,
  • conduct inspections, appraisals, market advice and due diligence,
  • verify identity, manage risk, prevent fraud, and maintain security,
  • process payments and manage accounts,
  • comply with legal and regulatory obligations and cooperate with regulators and law enforcement where required/authorised,
  • manage complaints and improve our services, and
  • send relevant updates/marketing where permitted (and you can opt out—see below).

 We may disclose personal information to third parties where needed to deliver our services, including:

  • vendors/purchasers/landlords/tenants and their representatives,
  • contractors and service providers (e.g., IT, cloud hosting, software providers, marketing, mailing houses),
  • professional advisers (e.g., lawyers, accountants),
  • finance/settlement and payment providers (where relevant),
  • insurers, and
  • regulators and authorities where required or authorised by law.

 4) Direct marketing

 Where permitted, we may contact you with marketing about properties, livestock opportunities or services that may be of interest. You can opt out at any time by using the unsubscribe link (if applicable) or contacting us using the details below.

 5) Overseas disclosures

 Some of our service providers (for example, cloud or software providers) may store or access personal information from locations outside Australia. Where we disclose personal information overseas, we will take reasonable steps to ensure the overseas recipient handles it in a manner consistent with Australian privacy requirements, unless an exception applies.

 6) Accessing and correcting your personal information

 You may request access to the personal information we hold about you and request corrections if you believe it is inaccurate, out of date, incomplete, irrelevant or misleading. APP 1 requires privacy policies to explain how individuals can access and correct their information. 

We may need to verify your identity before providing access or making changes. In some circumstances, we may refuse access or correction where permitted by law, and we will explain why.

 7) Complaints

 If you believe we have breached the APPs or a binding privacy code, you can complain to us. APP 1 requires privacy policies to explain how complaints can be made and handled. 

We will acknowledge your complaint and aim to respond within a reasonable timeframe.

 If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC).

 8) Data breaches

 We take data breaches seriously. Where required, we will comply with the Notifiable Data Breaches (NDB) scheme, including notifying affected individuals and the OAIC of eligible data breaches likely to result in serious harm.
